Terms of Service

These Terms explain the rules for using Homora and the responsibilities that remain with landlords, tenants, and other users.

1. Agreement to these Terms

By creating an account, accessing Homora, or using the service, you agree to these Terms and acknowledge Homora’s Privacy Policy. If you do not agree, do not use the service. If you use Homora for a business or property owner, you represent that you have authority to bind that organization.

2. Eligibility and account security

  • You must be at least 18 years old and legally able to enter contracts.
  • Provide accurate information and keep it current.
  • Protect your password and account access. You are responsible for activity performed through your account unless prohibited by law.
  • Do not impersonate another person, create unauthorized accounts, or share access in a way that exposes private rental records.

3. Homora’s role

Homora provides software that helps landlords and tenants organize rental listings, tour requests, applications, tenancies, leases, messages, maintenance, inspections, documents, signatures, and ledger records. Homora is not a landlord, tenant, property manager, real-estate broker, attorney, insurer, credit bureau, screening company, escrow agent, or payment institution.

Rental relationships, property conditions, tour access, lease terms, notices, repairs, deposits, payments, and legal compliance remain the responsibility of the relevant landlord and tenant. Homora does not provide legal advice or guarantee that a document, notice, deadline, listing, or transaction satisfies every law.

4. Housing and listing responsibilities

Landlords are responsible for lawful property management, safe tour access, habitability, licensing, disclosures, deposits, notices, fair-housing compliance, screening criteria, and the accuracy of listings and rental terms. Users may not use Homora to discriminate based on a protected characteristic or to request, publish, or infer information for an unlawful housing decision.

Tenants are responsible for reviewing listing and lease information, providing accurate tour and application details, meeting agreed obligations, and promptly communicating material issues. Homora does not inspect or endorse listed properties, and a tour request is not confirmed until the landlord accepts it.

5. Documents and electronic signatures

Users decide which documents to upload, prepare, share, and sign. Each party must review the complete document, verify all blanks and required disclosures, confirm signer authority, and obtain legal advice when appropriate. Some documents may require witnesses, notarization, special delivery, or may not be suitable for electronic signing.

When you sign through Homora, you intend your action and entered name or initials to serve as your electronic signature. Homora records consent, signer identity information, timestamps, assigned fields, and document fingerprints and preserves the original PDF separately from the completed copy. Review the Electronic Records and Signature Consent before signing.

6. Rent records and payments

Homora currently maintains ledger entries for charges, credits, refunds, and offline payments recorded by users. Homora does not currently move, hold, settle, or insure real rent funds and does not verify that an offline payment actually occurred. Users must independently verify payment instructions and receipts.

If payment processing is introduced later, separate provider terms, fees, authorizations, and disclosures may apply before anyone sends money.

7. Acceptable use

You may not use Homora to break the law, harass or threaten someone, discriminate, commit fraud, upload malware, probe security, bypass access controls, scrape private information, send spam, interfere with the service, infringe rights, or upload content you do not have permission to use. Emergency repair or safety issues should be handled through emergency services and appropriate property contacts, not solely through Homora.

You retain ownership of content you provide. You grant Homora a limited license to host, process, reproduce, and share that content only as needed to operate and protect the service and carry out your instructions.

8. Suspension, termination, and deletion

You may stop using Homora or delete your account from Settings. Homora may limit or suspend access when reasonably necessary to protect users, investigate misuse, comply with law, or prevent harm. Shared and legally relevant records may remain available in anonymized form after account deletion as described in the Privacy Policy.

9. Disclaimers

Homora is provided on an “as is” and “as available” basis to the extent permitted by law. Homora does not warrant uninterrupted operation, perfect security, the condition or availability of a property, the identity or conduct of another user, the accuracy of user content, the enforceability of a document, or any particular legal, housing, or financial outcome.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

10. Limitation of liability

To the extent permitted by law, Homora will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, housing opportunities, or business interruption arising from the service. Homora’s total liability for a claim will not exceed the greater of amounts you paid Homora during the prior twelve months or $100.

Nothing in these Terms limits liability that cannot lawfully be limited or excludes rights provided by applicable consumer law.

11. Governing law and changes

These Terms are governed by Florida law, except where federal law or another jurisdiction’s non-waivable law applies. Any dispute that cannot be resolved informally may be brought in a court with lawful jurisdiction. These Terms do not include mandatory arbitration in this pilot version.

Homora may update these Terms as features and legal requirements change. Material changes will be posted with a new effective date and, when appropriate, presented for renewed acceptance.
